These Terms of Service apply to the Shemaya Home Decor website and purchases from Shemaya Pty Ltd. By accessing the website or placing an order, you agree to these terms.
Products and pricing
Prices are displayed in Australian dollars and include GST where applicable.
We take reasonable care to ensure descriptions, images, dimensions and prices are accurate. Colours may vary slightly between screens and printed products. If we identify a material error before fulfilling an order, we will contact you and provide the option to proceed with corrected information or cancel the order for a refund.
Orders
An order is accepted when we confirm it and begin fulfilment. We may refuse or cancel an order where payment cannot be authorised; a product or material is unavailable; supplied information appears incorrect or fraudulent; a pricing or product-description error has occurred; or fulfilment would breach applicable law. If we cancel a paid order, we will refund the affected amount.
Made-to-order products
Most canvas products are made specifically for each customer after ordering. Customers should confirm their chosen design, dimensions, format and delivery details before completing checkout.
Custom images
By submitting an image, you confirm that you own the image or have permission to reproduce it; its use does not infringe another person's copyright, privacy or other rights; and its content is lawful.
You grant Shemaya Pty Ltd permission to use the submitted image solely as reasonably necessary to produce and fulfil your order. We may decline content that appears unlawful, abusive or infringing.
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. Where a product does not comply with a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
Cancellations and returns
Cancellation and return arrangements are described in our Return and Refund Policy. Made-to-order and custom products are not eligible for change-of-mind returns, but this does not affect rights relating to faulty or non-compliant products.
Shipping
Production and delivery estimates are provided in our Shipping Policy. We are not responsible for delays outside our reasonable control, but this does not exclude any rights or remedies available under applicable law.
Website content
Unless otherwise stated, the Shemaya Home Decor name, website content, graphics, product photographs and original designs are owned by or licensed to Shemaya Pty Ltd. They must not be copied, reproduced, sold or commercially exploited without permission, except as permitted by law.
Liability
To the maximum extent permitted by law, Shemaya Pty Ltd is not liable for indirect or consequential loss that was not reasonably foreseeable. Nothing in these terms limits liability or remedies where doing so would be unlawful, including liability arising under the Australian Consumer Law.
Privacy
Personal information is handled in accordance with our Privacy Policy.
Changes
We may update these terms periodically. Changes apply from the date they are published and do not retrospectively alter an order already accepted unless required by law or agreed with the customer.
Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the courts with jurisdiction in New South Wales, subject to any rights customers have under applicable consumer law.
